These Terms of Service ("Terms") are a legal agreement between you and McPeak Enterprises LLC ("we," "us," "our") governing your use of the Needle Minder mobile app and this website (together, "the Service"). By downloading, installing, or using the app, you agree to these Terms. If you don't agree, please don't use the Service. You must be at least 13 years old (or older if required by your country's laws) to use the Service.
We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use Needle Minder on devices you own or control, for your own stitching and embroidery purposes — whether hobby or professional. This license is subject to these Terms and to the rules of the app store you downloaded from.
The app store you downloaded from imposes additional rules on how the app may be used (for example, Apple's Usage Rules). Those rules, along with the store-specific provisions in App store terms below, form part of this license.
Needle Minder is local-first: your stash, projects, and settings are stored on your device, not on our servers. That gives you control, but it also means you are responsible for backing up your data. We cannot recover data that is lost because a device is lost, damaged, reset, or because the app is deleted, since we never hold a copy.
We strongly recommend exporting a backup file regularly and keeping it somewhere safe. See the in-app Backup feature and our Privacy Policy for how backups work.
The app includes reference thread catalogs (color numbers, names, families, and approximate colors) to help you organize your stash. These are provided for convenience and may contain errors or omissions, and on-screen colors are approximations that vary by display. Always verify against the physical thread and the manufacturer's labeling before purchasing or stitching. Brand names and color numbers are the property of their respective manufacturers and are used for identification only.
You agree not to misuse the Service. In particular, you won't:
The Needle Minder Pro upgrade is a one-time, lifetime purchase processed entirely by the app store you downloaded from — Apple (App Store) or Google (Google Play). We never handle your payment information directly. Any price will be shown to you clearly before you confirm a purchase.
If something isn't working the way you expected, please reach out to us first at support@needleminder.app. Many problems can be resolved quickly, and we want you to have a good experience with the app.
All refund decisions are made by the store you purchased from. We are not able to issue refunds directly, but here is where to go:
After the store processes a refund, your Needle Minder Pro access will return to the free tier the next time the app checks your purchase status — typically the next time you open the app with an internet connection.
The Needle Minder app, its design, the "Needle Minder" name, and the related branding are owned by McPeak Enterprises LLC and are protected by intellectual-property laws. These Terms don't transfer any ownership to you — only the limited license described above. The content you create in the app (your stash entries, project plans, and notes) remains yours.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that it will meet every need. You use the Service at your own discretion and risk. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
To the fullest extent permitted by law, McPeak Enterprises LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service — including data lost because it wasn't backed up. To the extent any liability is not excludable, our total liability is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or USD $25. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
We may update, change, or discontinue features of the Service over time. We may also update these Terms; when we do, we'll revise the "Last updated" date above, and for material changes we'll give a more prominent notice. If you keep using the Service after changes take effect, you accept the updated Terms.
You can stop using the Service at any time by deleting the app. We may suspend or end the license if you materially breach these Terms. Sections that by their nature should survive — such as intellectual property, disclaimers, and limitation of liability — will continue to apply after termination.
These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Arkansas will have jurisdiction over any dispute that isn't subject to a different mandatory consumer-protection rule in your home jurisdiction.
You download Needle Minder through a third-party app store, and your use of the app is also subject to that store's terms. The provisions below are required by those stores. If anything in these Terms conflicts with a store's own terms, the store's terms control for downloads made through that store.
If you obtained the app from the Apple App Store, you acknowledge and agree that:

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. The app is provided by McPeak Enterprises LLC, not Google, and Google is not responsible for the app or its content. To the extent of any conflict between these Terms and the Google Play Terms of Service, the Google Play Terms of Service govern with respect to your download from Google Play.
